Stormwater – Construction and AZPDES PERMITS

Do I need an Arizona Pollutant Discharge Elimination System (AZPDES) Permit?
As of 2003, a Construction General
Permit is required for both small and large construction activities.
- Does your project disturb one or more acres of land?
- Does your project disturb less than one acre at this time but is part of a larger common plan of development that will later disturb more acreage through grading, clearing, excavating, or stockpiling of fill materials?
- Is there any possibility that your construction site may have stormwater runoff?
If the answer is “YES” to any of these questions you are required to apply for a permit.
According to the Arizona Department of Environmental Quality (ADEQ) the Operator is required to obtain an AZPDES General Permit for construction activity discharges if the activities of the site will disturb one acre or more; or disturbs less than one acre but is a part of a larger development.
A Stormwater Pollution Prevention Plan (SWPPP) must be developed and implemented according to the terms of the AZPDES General Permit. The plan, if properly implemented, is designed to reduce the amount of construction site contaminates that may enter into the washes when construction occurs and land surfaces are disturbed.
The Notice of Intent must be posted in a publicly visible location at the construction site.
